2026 HENRY HUDSON TRAIL DONUT DERBY – WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
In consideration of being permitted to participate in the 2026 Henry Hudson Trail Donut Draft Derby (the “Event”) organized by Ride To Remember Inc. on May 16, 2026, on the Henry Hudson Trail, I, the undersigned participant, agree as follows:
1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand and acknowledge that participation in the Event involves inherent risks, including but not limited to risks of serious bodily injury, disability, death, and property damage. These risks include, without limitation:
- Falls from a bicycle;
- Collisions with other participants, pedestrians, vehicles, or fixed or natural objects;
- Road and trail conditions, including uneven surfaces, debris, and environmental hazards;
- Weather-related conditions;
- Overexertion and fatigue;
- Risks associated with stopping, starting, or congestion at designated donut consumption stations;
- Consumption of food during the Event, including risks of choking, allergic reactions, gastrointestinal distress, nausea, or vomiting;
- Risks arising from my own actions or inactions, or those of other participants.
I acknowledge that food provided during the Event may contain allergens, including but not limited to gluten, dairy, nuts, and other ingredients.
I acknowledge that the Event takes place on a multi-use trail and agree that pedestrians have the right-of-way at all times. Riders must yield, provide audible warning when passing, and operate at a safe speed appropriate to conditions.
I voluntarily and knowingly assume all such risks, whether known or unknown, even if arising from the ordinary negligence of the Releasees (defined below), to the fullest extent permitted by the laws of the State of New Jersey.
2. RELEASE AND WAIVER OF LIABILITY
In consideration for being permitted to participate in the Event, I, on behalf of myself and my heirs, executors, administrators, assigns, and next of kin, hereby release, waive, discharge, and covenant not to sue Ride To Remember Inc., its officers, directors, employees, volunteers, agents, sponsors, contractors, The State of New Jersey, The County of Monmouth, the Monmouth County Board of Recreation Commissioners, the Borough of Atlantic Highlands, NJ and their respective officers, officials, employees, servants, and agents, and all other persons or entities associated with the Event (collectively, the “Releasees”), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, whether caused by the ordinary negligence of the Releasees or otherwise, to the fullest extent permitted by law.
This release does not apply to claims arising from gross negligence, willful misconduct, or any other liability that cannot be waived under applicable law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my participation in the Event, including any claims brought by third parties resulting from my actions or omissions.
4. FITNESS TO PARTICIPATE AND EQUIPMENT
I certify that:
- I am at least twenty (20) years of age and meet the Event’s minimum participation age requirement;
- I am physically and mentally capable of safely participating in the Event;
- I have no medical condition that would impair my ability to safely participate, including conditions affected by physical exertion or consumption of sugary foods;
- My bicycle is in safe working condition.
I acknowledge that I am solely responsible for my own safety equipment.
Helmet use is mandatory, and failure to wear a properly fitted helmet may result in removal from the Event without refund.
5. MEDICAL AUTHORIZATION AND INSURANCE
I consent to receive emergency medical treatment deemed necessary during the Event. I authorize Event personnel to obtain such treatment on my behalf if I am unable to do so.
I authorize the Event organizers to contact my designated emergency contact in the event of injury or illness.
I understand that I am solely responsible for all medical costs incurred as a result of my participation. I acknowledge that the Releasees do not provide medical, health, or accident insurance coverage, and I represent that I have my own adequate insurance coverage.
6. RULES, CONDUCT, AND REMOVAL
I agree to comply with all Event rules and instructions, including but not limited to staggered start procedures, safe riding practices, and trail etiquette.
I understand that the Event is a relaxed-format vintage single-speed ride emphasizing safety, fun, trail etiquette, and donut consumption over speed or competitive performance..
Event organizers reserve the right, in their sole discretion, to remove any participant who engages in unsafe, reckless, or disruptive behavior, or who fails to comply with Event rules.
7. PHOTO AND MEDIA RELEASE
I grant permission to Ride To Remember Inc. and its designees to use my name, likeness, image, voice, and appearance in photographs, videos, or other media taken during the Event for promotional, marketing, or other lawful purposes, without compensation.
8. GOVERNING LAW AND SEVERABILITY
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9. ACKNOWLEDGMENT
I have carefully read this Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to sue. I acknowledge that I am signing this agreement freely and voluntarily, without any inducement, assurance, or guarantee.
Compliance with NJ Bicycle Laws
Participants must comply with New Jersey bicycle laws (Title 39), including:
- Bicycles are vehicles and riders must follow all applicable traffic laws;
- Cyclists must yield the right-of-way to pedestrians at all times, including on trails and at crossings;
- Bicycles must be equipped with an audible signaling device (bell) capable of being heard at least 100 feet;
- Riders must operate in a safe and controlled manner, including riding to the right and no more than two abreast unless conditions require single file.
Helmet use is required for this Event regardless of state minimum requirements.
